1. Who we are
Premia Solutions Limited (“we”, “us”, “our”), is a company registered in England and Wales (company number 04088720) who acts as an administrator and a claims and complaint handler for general insurance policies and non-FCA regulated plans (referred to throughout as a policy or plan, as appropriate).

2. Responsibility for data
We act solely as a data processor. This means we do not determine the purposes or means of processing personal data and only process it as instructed by the data controller (the insurer or plan provider) and in accordance with the applicable data protection laws, including the UK GDPR and the Data Protection Act 2018.

This privacy policy details what personal data we collect and your rights in relation to that personal data, why we collect it and how we ensure its security. We are committed to protecting the confidentiality, integrity and security of all personal data entrusted to us.

You can find details of your data controller and the lawful bases they have for obtaining your personal data in your policy/plan documents. Where you did not go on to take out a policy, you can contact us for further details.

3. Collection of information
We collect your information from the dealer, leasing broker, finance provider or website where you purchased your policy or plan. This happens so we can fulfil our contractual obligations and carry out our administration, claims and complaint handling activities.

We also collect your information when you register your interest in a policy either directly with us or via a partnering third-party.

We also collect any information you provide to us through our websites and when contacting us via phone, email or letter.

The type of information we collect depends on the services we provide you with and may include:
  • your name and address, phone number and e-mail address
  • vehicle information e.g. make, model and registration number, delivery date, purchase details
  • information we require to allow us to identify the right product for you and provide you with appropriate cover
  • payment information (bank account and credit/debit card details)
  • policy/plan information (policy/plan references, cover details, complaint references and details)
  • claims information (reference numbers, details of any incidents, supporting evidence and investigations)
  • your date of birth should we need to perform legally required sanctions checks
  • general details about your employment e.g. employer name, role, working hours, employment status, tenure
  • unemployment and job-seeking information e.g. awards or confirmation letters from the Department for Work and Pensions, evidence of your Jobseeker’s Allowance entitlement or Information demonstrating active job-seeking efforts
  • website activity and usage analytics
We do not ordinarily collect or process sensitive personal data. However, in certain circumstances, such as when assessing a claim or fulfilling our regulatory obligations to identify and support vulnerable customers, we may receive or need to process health-related or other sensitive information. Where this occurs, we will process such data in accordance with applicable data protection laws and legal bases.

4. Use of information
As a processor, we rely on the lawful bases determined by the data controller while carrying out our processing activities. The controller is responsible for ensuring that a valid legal basis exists for all the following:
  • verifying your identity
  • providing administration and customer support
  • recording phone calls for training and monitoring purposes
  • claims and complaint handling
  • detecting fraudulent activities
  • complying with our statutory and regulatory obligations
  • customising our websites according to your interests
  • ensuring that content from our sites is presented in the most effective manner for you and for your computer
  • contacting you and gathering feedback on your experience with us and any third-party service provider you engage with
  • providing you with information, products or services that you request from us or which we feel may interest you.
5. Sharing of information
To ensure we can carry out our activities as required by the data controller, we may disclose your personal data to third parties involved in providing products or services to us, or to service providers who perform services on our behalf. These include any companies who, along with us, are part of The Fortegra Group Inc, the insurer or plan provider, repairers, third party processors, credit card and bank payment providers, fraud detection agencies, IT service providers, customer review platforms, external law firms, external accountants and auditors and regulatory authorities.

The third parties with whom we may share your data will depend upon the policy/plan you have. They will only process it for the specific purposes outlined in this policy. You should seek clarification from these companies directly should you have any queries about how they may use your personal data. If we sell or buy any business or assets, we may disclose your information to the buyer or seller of the assets.

We will not pass your information on to anyone else unless allowed or required by law.

6. International transfers of data
We may transfer your personal data outside of the UK or the European Economic Area. If this happens, we will ensure that appropriate safeguards are in place such as adequacy regulations, Standard Contractual Clauses and additional technical and organisational measures.

7. Storage and security
We will take appropriate steps to ensure that your information is safe and secure at all times. This will include the physical security to our offices and the technical security of our IT systems.

We will also take all reasonable steps to ensure that your data is treated in accordance with this privacy policy.

Any information that we collect about you is stored electronically on our database on secure servers. Please note where we provide links to other websites on our website, they are not governed by this privacy policy and their operators may collect and use your information differently.

Any payment transactions are encrypted using SSL technology. We have appointed an agent to collect debit/credit card payments from you. All debit/credit card transactions conducted are carried out over a secure link for your security. By transmitting your debit/credit card details, you agree to our agent using your details for the purposes of:
  • authorising your debit/credit card;
  • debiting your debit/credit card account for any services you buy; and
  • advising us that payment has been made.
The transmission of information via the internet is not completely secure. This risk is not specific to our websites and is common across the internet. Although we will do our best to protect your personal data in these instances, we cannot guarantee the security of data transmitted to our site, therefore any transmission is at your own risk.

Once we have received your information, we will use procedures and security features to try to prevent unauthorised access. Where we have given you (or where you have chosen) a password which enables you to access certain parts of our site, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.

As part of our responsibilities we will retain records for 10 years after the expiry of a policy or a plan, or longer if there are outstanding claims, disputes or legal obligation requiring continued retention. We will retain your personal data to the extent necessary to meet these requirements. Data is only retained where necessary and will not be kept longer than is strictly required. Once the data is no longer required, we will anonymise it.

8. Your duty to inform us of changes
It is important that the personal information we hold about you is accurate and current. Please keep us informed if your personal information changes during your relationship with us.

9. Your rights in connection with personal data
We will always process your personal data fairly and lawfully and for the specified purpose of our business dealings.

We will ensure that the personal data we hold is relevant, not excessive and will not be held any longer than is necessary and in line with our retention policy.

You also have the following rights by law:
  • Right of access: Also known as a subject access request, you have the right to obtain from us whether your personal data is being processed, where and for what purpose; the categories of personal data we are processing; who we have shared it with; and a copy of the personal data we hold about you. We will provide you with this information within one calendar month of receiving your request and verifying your identity. If the request is complex, we may extend the response time. We will inform you if this is the case and explain why.
  • Right to rectification: If you believe that any of the information we hold about you is incorrect, you have the right to request that we amend your details accordingly.
  • Right to erasure/right to be forgotten: You may also ask us to erase your personal information from our systems. There are some specific circumstances where the right to erasure does not apply, and we are permitted to hold your data. We will explain the reason for this at the time, should this occur.
  • Right to object: Where we are relying on the legitimate interests of the data controller, you have the right to object to the processing of your personal data. You also have the right to object where we are processing your personal information for direct marketing purposes. You can contact us at any time should you no longer want to receive marketing communications from Premia Solutions by emailing support@premiasolutions.com. Please note, even if you opt out of marketing communications, we may need to send other forms of documentation to you to ensure we can fulfil our contractual obligations.
  • Right to restrict processing: You have a right to request that we suspend the processing of your personal data in certain circumstances, for example if you want us to establish its accuracy or the reason for processing it.
  • Right to data portability: You have the right, in certain circumstances, to receive a copy of the personal data you have provided to us in a structured, commonly used, machine-readable format that supports re-use, or to request the transfer of your personal data to another person.
  • Rights in relation to automated decision making and profiling: You have the right not to be subject to decisions made solely by automated means (e.g. a computer) or profiling (automated processing of your personal information to evaluate certain things about you). Where such processing occurs, you also have the right to request human intervention, express your point of view and contest the decision.

You will not have to pay a fee to access your personal information (or to exercise any of the other rights). However, we may charge a reasonable fee to cover our administrative costs if your request for access is clearly unfounded, vexatious or excessive. Alternatively, we may refuse to comply with the request in such circumstances.

10. Changes to this privacy policy
We reserve the right to update this privacy policy at any time and without prior notice to you to reflect changes in our information practices or relevant laws. You can see when this policy was last updated by looking at the date at the top of the policy. Any changes to our policy will become effective upon posting of the revised policy on the site. Use of our site, any of our products and services and/or providing consent to the updated policy following such changes constitutes your acceptance of the revised policy then in effect.
